Are Companies Required To Pay Overtime?
For most workers who work shifts and get paid in some form by the hour, absolutely! There are some exceptions: management; licensed professionals, such as lawyers, accountants, or doctors; and salespeople of many different kinds. If you are an employee, you work shifts, you get paid by the hour, and you work for a boss, chances are high that for all time over and above 40 hours a week, your employer is required to pay you time-and-a-half. I’m still surprised how many times I hear my clients tell me, in major industries such as healthcare, construction, restaurants, beauty care, and many others, that they’re working 60 to 70-hour weeks, and they’re not being paid mandatory overtime. The law also imposes penalties and fines on companies that don’t follow this law. In many cases, workers can recover almost double their back-wages plus additional penalties going back three, maybe even six years under state law, depending on the case.
