What should I do after slipping on the ice?
It depends on where you fell. Was it snowing at the time? In New York, if you slip and fall during a storm, there’s not going to be any liability against the property owner for that. Every property owner – and I think the mayor told everyone this a couple years ago – has four hours to clean up the ice and snow outside their property. If it’s at least four hours and you slip and fall on ice, there could be a lawsuit against that property owner. Again, the 90-day requirement applies if it’s a city-owned building or a Housing Authority building. Every property owner is responsible to clean up the ice and snow, however, if it’s a single family house, some of the houses up in the Bronx, or less than a three family house, then the City of New York is still responsible and a notice of claim must be filed. The most important thing here is that you contact a lawyer so they can determine whether or not the City of New York is responsible and a notice of claim must be filed.
